Your contract will either be with us or with a supplier of travel services. This will depend on the type of arrangements you book. Your contract will be with us if we arrange the following services: accommodation (a) transport (b) other tourist services (c) not ancillary to transport or accommodation which account for a significant part of the arrangements. For all other arrangements, we are the Booking Agent for a number of suppliers. Your contract will be with the supplier and we accept no responsibility for their actions. 2. Recognizing the supplier of the service We always stand as a supplier for following services: a) Transfer arrangement b) Special guided tour c) Conference or special programme management d) Advertisement at sites Prague-guide.com, 123-prague.com, 123-praha.com, 123praha.com, 123-praha.biz, 123-prague.biz, 123praha.biz, 123prague.biz e) Rent a bus We never stand as a supplier for following services: a) Rent a car We may be a supplier for following services: a) Standard guided tours b) Accommodation c) Other services e.g. ticket booking You can recognize if we are not the supplier by following ways: a) Accommodation - If we are not the supplier of the service the presentation of the supplier shows a short note "DIRECT BOOKING" , otherwise we are the supplier and the booking is made on the terms of our conditions. b) Standard guided tours - If we are not the supplier of the service, you are asked by our company to pay to a different operator or service provider than httpHFS s.r.o.. The receipt will include the name of the current supplier. You will not receive the bill from HFS s.r.o.. c) Other services e.g. ticket booking - You will be told if we are the supplier or if we are the booking agent when you will be asked to pay for the service. 3. MAKING YOUR BOOKING You can book the services or arrangements and take up the offers advertised in this web site. You can book any service advertised at our website by email, phone +420 777 885 925 or through a form which is accesible at every site that provides any service. A contract will be made when confirmation is given by us (whether verbally in person or on the telephone, or in writing) or, if we are the Booking Agent, is given by us on behalf of your supplier. If we are unable to confirm certain arrangements straight away (e.g. where accommodation is only available on request) we may issue a confirmation invoice. All bookings made through our site do not bind you to anything. You will not be charged any fees until you agree with the booking, payment and cancellation policy. This condition is either valid for cases you request a DIRECT BOOKING. The service supplier has no right to charge you any fees until you both agree. If you ever register a problem with payment or you think you are being pushed to unwanted action, do not hesitate to contact us by email, phone +420 777 885 925 or through a form which is accesible at the sites. 4. PAYMENT AND CANCELLATION All payment conditions depend on your booking and the type of service. It is set individually. In general we request no pre payment or deposit for the services, unless it is requested by other suppliers we cooperate with or the service is more expensive than CZK 20.000,--. You may be asked for credit card details and other data needed for successful booking. The credit card details are given to our company by fax or phone or specially secured protocol (the link will be sent you with the confirmation voucher). In case you do not provide us your credit card number and all the necessary details, the booking will be guaranteed until 4pm of the one day prior arrival day. The reservation can be cancelled 2 days prior the arrival day. In case you do not cancel your reservation until then, you will be subject to a 'no-show' charge equal to first night room rate plus tax, which will be charged to the credit card. In case that we serve as a booking agent the service supplier is suppossed to give you its own payment and cancellation policy and booking conditions. 5. CHANGES If you want to make any changes to your booking after it has been confirmed e.g. departure date, hotel, passenger names, etc, you must tell us in writing, and we will try to help subject to availability. We will charge no fee for the change. Please note that some arrangements cannot be changed after the contract is made. 6. OUR RESPONSIBILITY TO YOU We make every effort to ensure that all arrangements are made correctly and efficiently. Sometimes hoteliers, excursion companies, etc may suddenly withdraw a facility or service, temporarily or otherwise, which causes a change in the arrangements we have made. If we are your Booking Agent, liability to you on the part of your supplier may be limited by its conditions of contract. If your contract is with us, we accept responsibility for the negligent acts and/or omissions of our employees, agents, suppliers and sub-contractors provided they were at the time carrying out work in the course of their employment or contract. We also accept responsibility if the services which we have agreed to provide are defectiveor not as described in this web site or any amendments to it. 7. COMPLAINTS If we are the Booking Agent, your contract with your supplier may have a complaints procedure to follow. If your contract is with us and you have a complaint about your arrangements whilst away, you must immediately notify the supplier of the service in question. If they are unable to resolve the problem immediately, you should contact us straight away and we will endeavour to assist. If you are still not satisfied on your return home, you must write to us within 28 days of your return with full details of your complaint and we will deal with it as quickly as possible. 8. SPECIAL REQUESTS If you have any special requests, you should tell us at the time of booking. We and our suppliers will try to meet such requests but, as these do not form part of your contract with us or with your supplier, we do not guarantee to do so, including for pre-bookable seats. If we confirm a special request has been noted or passed to the supplier or refer to it on your confirmation invoice or elsewhere, this is not a guarantee to meet it. You will not be specifically notified if a special request cannot be met. We do not accept bookings which are conditional on the fulfilment of any special request. 9. PRIVACY POLICY - The information we collect and how we use it HFS s.r.o. is committed to protecting your privacy and this Privacy Policy sets out what information we collect, how we collect it, and what we do with it. Your Information This refers to information such as your name, contact details, travel preferences and special needs/disabilities/dietary requirements that you supply us or is supplied to us, including any information about your friends or family relating to the same ('your information'). Your information is collected when you request information from us, contact us (and vice versa) or make a booking with us. You are responsible for ensuring that your friends and family are aware of the content of our privacy, booking, payment and cancellation policy. Policy and consent to your acting on their behalf in all your dealings with us. We will update your information whenever we get the opportunity to keep it current, accurate and complete. 10. DIRECT MARKETING MATERIAL You may indicate your preference not to receive direct marketing material in the relevant opt-out boxes or be asked the same by our staff at the time you first supplied us your information (or at the earliest opportunity). Otherwise, we may share your information with our group companies and other carefully selected third parties who may contact you for direct marketing purposes and for research purposes. For example, we on their behalf or they may contact you with travel information, offers of goods and services, forthcoming events or competitions considered to be of interest to you. If you change your mind, you should inform us in writing. Once properly notified by you, we will take steps to stop sharing your information. 11. YOUR RIGHTS You have the right to ask in writing for a copy of the information we hold about you (for which we may charge a fee) and to correct any inaccuracies in your information.
